I have an idea for a perfume, however the name I wish to use has already been used, by Avon, and I was wondering. A. how long does a copyright law last on names of products (my product will be different but with the same name) B. Can I use the name if it is under copyrights. If so where, who, and how, do i get permission to use this name.
for the sake of arguement were going to call the perfume X.
I have the idea for the bottle, the box, the scent, and the commerical and the name.

Copyright laws last much longer than what you will be on this earth for. Every year Avon renews their copyrights. You will be violating copyright laws to use the same name for the exact same product.
70 years afer the death of the person or company that had that copyright. In you example that copyright will remain in effect 70 years after Avon go’s out of business.
Apply yo avon for the right to use that name.
